Separation Agreement

A Separation Agreement is a legally binding contract negotiated and entered into between you and your spouse. Such an agreement resolves all issues such as custody, visitation and child support.

A Separation Agreement also addresses such issues as which spouse retains the marital home, division of retirement/investment accounts that may have been accumulated during the marriage by you or your spouse as well as deny allocation for debts incurred during the marriage.


There a various requirements to meet the jurisdictional elements on order to commence a Divorce action in New York State.

Filing a Divorce action requires filing fees and "grounds" for the Divorce must be alleged. There are various grounds for divorce in New York State such as Abandonment, Cruel & Inhuman Treatment and Irretrievably Broken for at least 6 months to name a few. New York State is not a "no-fault" state and grounds may be opposed by the defendant spouse.
